On November 20, 1896, the preliminary inquiry against Rizal began after gathering as much information as possible. Rizal was briefed of the allegations against him before Judge Advocate Colonel Francisco Olive during the five-day investigation.

He was subjected to interrogation without knowing who testified against him. There were two types of evidence presented to him: documentary and testimonial.

Colonel Olive forwarded these evidences to Governor Ramon Blanco, who appointed Captain Rafael Dominguez as the Judge Advocate in charge of determining what action should be taken. Dominguez, after a cursory perusal, forwarded the data to Judge Advocate General Don Nicolas de la Pea for his opinion. Pea's suggestions were as follows:

Rizal must be tried quickly to trial. He must be imprisoned with the required security.His holdings had to be attached, and Rizal had to pay one million pesos as an indemnity.Only an army officer is permitted to represent Rizal, rather than a civilian counsel.

I investigated his case and discovered nothing that might implicate him as a participant in, or even the leader of, the revolution. Rizal is innocent as he is, and I ask you to put all biases aside right now because I will establish his innocence at whatever cost.
